The Neuromarketing Paradox: Theorizing Cognitive Privacy and the Boundaries of Hyper-Persuasion

Purpose: The rapid integration of scalable artificial intelligence, affective computing, and wearable neurotechnology has transitioned neuromarketing from a descriptive, laboratory-bound evaluative tool into a dynamic, real-time algorithmic architecture. Brands now routinely deploy "hyper-persuasion" tactics—utilizing biometrics to continuously bypass conscious cognitive evaluation and trigger spontaneous, heuristic-driven behavioral compliance. However, while global regulations (such as the GDPR) robustly protect digital informational privacy, they are structurally inadequate to safeguard continuous, pre-cognitive mental data. This conceptual paper addresses this critical gap by investigating the ethical and long-term relational consequences of unregulated commercial cognitive surveillance. Theoretical Approach: Synthesizing literature from consumer neuroscience, psychological reactance theory, dual-process theory, and emerging bioethical scholarship on "neurorights," this research bridges data ethics with consumer psychology. We formally introduce the construct of Cognitive Privacy to marketing management literature, defined as the inherent right of the consumer to maintain sovereignty over their internal emotional states, subconscious triggers, and neural data. Conceptual Framework & Propositions: The paper proposes a novel theoretical model: the Neuromarketing Paradox. This paradox dictates that as a brand’s ability to flawlessly bypass a consumer’s conscious defenses increases, long-term brand equity paradoxically collapses once the nature of the persuasion becomes perceptible. Through five formal, testable propositions, we model the perceived loss of cognitive privacy as a psychological mediator between neuromarketing intensity and brand trust. We argue that because hyper-persuasion is structurally invisible, the eventual exogeneous activation of persuasion knowledge (e.g., through a privacy disclosure or the algorithmic "creepiness factor") triggers profound moral disgust rather than standard ad-skepticism. Consequently, consumers do not merely switch brands; they engage in active, retaliatory defection and anti-consumption. Practical and Policy Implications: For brand managers, the paper provides actionable ethical boundaries by introducing the "Utilitarian Test" for neuro-optimization. It warns against covert algorithmic surveillance, advocating instead for a strategic shift toward transparent, "Zero-Party" biometric data co-creation. At the macro-regulatory level, the research highlights a glaring deficiency in global consumer protection, calling upon policymakers to formally codify neurorights into consumer law and mandate explicit algorithmic transparency disclosures for neuro-optimized digital environments. Originality and Value This paper challenges the prevailing marketing axiom that eliminating cognitive friction unilaterally enhances customer lifetime value. By expanding the boundary conditions of the Persuasion Knowledge Model (PKM) to account for structurally invisible biometric targeting, it provides a crucial theoretical roadmap for sustainable brand management in the rapidly expanding biometric economy.
